Artigo 1: Objeto

These General Terms of Sale (CGV) govern all commercial transactions between Koya, operated as a sole proprietorship under French law (the Seller), and any individual or entity purchasing premium services (the Client). By completing a purchase, the Client acknowledges having read and accepted these terms in their entirety.

Artigo 2: Serviços Premium

Koya offers premium subscription services on a monthly and annual basis, providing enhanced features and functionality for Discord server management. Premium services are digital in nature and are delivered immediately upon successful payment confirmation. Service features and benefits are described on our website.

Artigo 3: Preços e Pagamento

All prices are displayed in Euros (EUR) including all applicable taxes (TTC). The Seller reserves the right to modify pricing at any time; the price at the time of purchase shall apply to that transaction.

Payment processing is handled securely through Stripe (https://stripe.com). For more information, see Stripe's privacy policy and terms of use.

Artigo 4: Métodos de Pagamento

Payments are processed exclusively through Stripe. Accepted payment methods include:

  • Cartões de crédito (Visa, MasterCard, American Express)
  • Outros métodos de pagamento disponíveis através do Stripe dependendo do seu país

Artigo 5: Direito de Desistência

In accordance with Article L221-18 of the French Consumer Code, the Client has a 14-day withdrawal period from the date of purchase. To exercise this right, the Client must contact support at [email protected] clearly stating their wish to withdraw.

Partial waiver: As premium services are digital content delivered immediately upon purchase, by using the service immediately, the Client acknowledges and expressly agrees to a partial waiver of the withdrawal right pursuant to EU Directive 2011/83/EU Article 16(m).

Refunds, when applicable, will be processed using the same payment method within 14 days of the approved withdrawal request.

Artigo 6: Assinaturas e Renovação

Premium subscriptions automatically renew at the end of each billing period. The Client may cancel their subscription at any time through the self-service portal at koya.gg/subscriptions or by contacting support. Cancellations take effect at the end of the current paid period.

Artigo 7: Obrigações do Vendedor

The Seller commits to:

  • Fornecer serviços premium conforme descrito no site
  • Fornecer suporte técnico via Discord
  • Manter a disponibilidade do serviço (exceto durante manutenção)
  • Informar os clientes sobre mudanças importantes nos serviços

Artigo 8: Limitações de Responsabilidade

The Seller shall not be held liable for service interruptions caused by Discord platform outages or force majeure events. In the event of prolonged interruptions attributable to Koya, a goodwill gesture (such as a subscription extension) may be offered on a case-by-case basis.

Artigo 9: Proteção de Dados

Personal data collected in the course of transactions is processed in accordance with our Privacy Policy. Banking information is handled exclusively by Stripe.

Koya does NOT sell, rent, or share your personal data with third parties for commercial purposes. Your data remains strictly confidential and is used solely to operate our services and process transactions. IP addresses are collected during checkout for transaction security and fraud prevention.

Artigo 10: Disputas e Estornos

Before initiating any payment dispute or chargeback, the Client must contact our support team at [email protected] or via our Discord server to seek resolution.

Premium services are digital services delivered immediately. Unauthorized chargebacks for successfully delivered digital services may result in immediate account termination and a permanent ban from all Koya services.

Artigo 12: Modificação das Condições

The Seller reserves the right to modify these General Terms of Sale. Modifications take effect upon publication. Major changes will be communicated to Clients.

Artigo 13: Lei Aplicável

These General Terms of Sale are governed by French law. In the event of a dispute, an amicable resolution shall be sought before any legal action. Failing that, French courts shall have exclusive jurisdiction.
